Data Privacy Policy for our Website

 

General information

The protection of your personal data is very important to us. When you visit our website, our web servers store the IP of your Internet service provider, the website from which you visit us, the websites you visit on our website and the date and duration of the visit. The processing of this data is strictly necessary to provide you with the website. We have concluded a data processing agreement with the provider in accordance with the requirements of Art. 28 GDPR, in which we oblige the provider to protect the data of our customers and not to pass it on to third parties.

When you access our website, it is technically necessary that data is transmitted to our web server via your internet browser. The following data is recorded during an ongoing connection to communication between your internet browser and our web server:

We collect the listed data in order to be able to guarantee a smooth connection to the website and the technically error-free provision of our services. The processing of this data is strictly necessary to provide you with the website. The log files are used for the evaluation of system security and stability as well as for administrative purposes. The legal basis for the processing of the data is our legitimate interest in the protection and functionality of our website in accordance with Art. 6 (1) (f) GDPR.

For reasons of technical security, in particular to defend against attack attempts on our web server, this data is stored by us for a short time. After 365 days at the latest, the data is anonymized by shortening the IP address at the domain level, so that it is no longer possible to establish a reference to the individual user.

In anonymised form, the data may be processed for statistical purposes. This data is not stored together with other personal data of the user, compared with other databases or passed on to third parties at any time.

Furthermore, we process data that we have collected from publicly accessible sources.

Purposes of data processing

We process your data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act 2018 in the applicable version:

  • for the fulfilment of (pre-)contractual obligations (Article 6 (1) (b) GDPR): Processing of your data is necessary for the purpose of fulfilling various legal obligations, e.g. from the German Commercial Code or the Tax Code.

  • to comply with legal obligations (Article 6 (1) (c) GDPR): Processing of your data is necessary for the purpose of fulfilling various legal obligations, e.g. from the German Commercial Code or the German Fiscal Code.

  • to safeguard legitimate interests (Art. 6 para. 1 lit. f GDPR): Based on a balancing of interests, data processing may take place beyond the actual performance of the contract to protect the legitimate interests of us or third parties. Data processing to safeguard legitimate interests is carried out, for example, in the following cases: advertising or marketing (see No. 4), measures for business management and further development of services and products; Maintaining a group-wide customer database to improve customer service, or in the context of legal prosecution.

  • within the framework of your consent (Art. 6 para. 1 lit. a GDPR): If you have given us consent to the processing of your data, e.g. to send us our newsletter.

 

Processing of personal data for advertising purposes

You can object to the use of your personal data for advertising purposes at any time, either in whole or for individual measures, without incurring any costs other than the transmission costs according to the basic rates.

Under the legal requirements of § 7 para. 3 UWG, we are entitled to use the e-mail address that you provided when concluding the contract for direct advertising for our own similar goods or services. You will receive these product recommendations from us regardless of whether you have subscribed to a newsletter.

If you do not wish to receive such recommendations from us by e-mail, you may object to the use of your address for this purpose at any time without incurring any costs other than the transmission costs under the basic rates. A notification in text form is sufficient for this purpose. Of course, every e-mail always contains an unsubscribe link.

 

Data transfer and recipients

Your personal data will not be transmitted to third parties unless

  • if we have explicitly pointed out in the description of the respective data processing,

  • if you have given explicit consent in accordance with Art. 6 (1) sentence 1 (a) GDPR,

  • the disclosure pursuant to Art. 6 (1) sentence 1 (f) GDPR is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,

  • in the event that there is a legal obligation for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR and

  • insofar as this is necessary for the processing of contractual relationships with you in accordance with Art. 6 (1) sentence 1 (b) GDPR.

In addition, we use external service providers for the processing of our services, whom we have carefully selected, commissioned in writing and, if necessary, with whom we have concluded order processing agreements in accordance with Art. 28 GDPR. They are bound by our instructions. These include, among other things, service providers for hosting, sending e-mails as well as maintenance and care of our IT systems, etc. The service providers will not pass on this data to third parties.

Duration of storage of personal data

The duration of the storage of personal data is measured by the relevant statutory retention periods (e.g. from commercial law and tax law), for the duration of the business relationship or any legal disputes in which the data is required as evidence. After the respective period has expired, the corresponding data is routinely deleted. If data is required for the performance of a contract or the initiation of a contract or if there is a legitimate interest on our part in further storage, the data will be deleted if it is no longer required for these purposes or if you have made use of your right of revocation or objection.

The right to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you can obtain information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data, if it has not been collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information on its details.

The right to request the rectification of inaccurate personal data or completion of your personal data stored by us without undue delay in accordance with Art. 16 GDPR.

The right to request the deletion of your personal data stored by us in accordance with Art. 17 GDPR, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.

The right to request the restriction of the processing of your personal data in accordance with Art. 18 GDPR, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you oppose its deletion and we no longer need the data, but you need it to assert, exercise or defend legal claims, or you have objected to the processing in accordance with Art. 21 GDPR.

The right, in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller.

The right to complain to a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of the federal state of our registered office indicated above or, if applicable, that of your usual place of residence or workplace.

The right to revoke consent given in accordance with Art. 7 (3) GDPR: You have the right to revoke your consent to the processing of data at any time with effect for the future. In the event of revocation, we will delete the data concerned without undue delay, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent before the withdrawal.

 

Right to object

If your personal data is processed by us on the basis of legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, insofar as this is done for reasons arising from your particular situation. If the objection is directed against the processing of personal data for the purpose of direct marketing, you have a general right to object without the requirement to specify a special situation.
